State Health Plan Provisions and The Affordable Care Act
 

There are important legal provisions that you should be aware of as an eligible member of the NC PPO Plans. These provisions are described in the New Employee Enrollment Guide on the State Health Plan website.

Health Insurance Marketplace Notice
The Affordable Care Act (ACA) imposes regulatory requirements on various segments of the population including providers, insurers, individuals and employers. Section 1512 of the ACA creates a new Fair Labor Standards Act (FLSA) section 18B that requires employers to provide notice to employees of coverage options available through the Health Insurance Marketplace, also known as the "Exchange".

As you read the notice, be aware that:

  • The State Health Plan, which is available to most Judicial Branch employees, meets the "minimum value standard" of the ACA.
  • The employer contribution to the cost of employee coverage is not available to participants in health plans other than the State Health Plan.
